DiscoveryIQ. Turning Big Data into Relevant Data for Intelligent eDiscovery.
When dealing with unexpected litigation or investigations, today’s organizations have to quickly access, understand, and act on a mountain of enterprise information – with no delays and no excuses. According the Federal Rules of Civil Procedures (FRCP), immediate action must be taken when there is “reasonable anticipation” of litigation. From the obligation of Notification through the critical Early Case Assessment (ECA) and into the Collection and Review stages, the entire eDiscovery process can be complicated and cumbersome – especially when trying to gain insight into petabytes of data. Developing and executing on a legal rubric that is repeatable, defensible, and cost effective is often a herculean task that carries tremendous legal risks and takes an enormous amount of time.
Enter DiscoveryIQ
With StoredIQ, the eDiscovery process is driven by DiscoveryIQ, an innovative application built to run on the StoredIQ Platform. DiscoveryIQ leverages a refined user interface designed to guide legal users through the entire eDiscovery process, providing inside counsel a defined methodology for managing the discovery workflow from legal hold notification and ECA to intelligent collections and export. The overall effect to the corporation is an organized, systematic, and defensible approach to eDiscovery resulting in more predictable legal costs and reduced risks.
Command and Control
The eDiscovery process begins with DiscoveryIQ’s matter-level dashboard, providing a high-level view of all matters in progress. Users can quickly assess the progression of all on-going litigation and investigations by viewing the amount of data across all matters that are in each phase of the eDiscovery process (e.g. data needing further Analysis, data that is preserved, or data that has been Exported, etc.). In addition, a user’s required action items are highlighted on the Dashboard, which are individualized based on the user’s role (Administrator, Legal Analyst, or Discovery Manager). From the dashboard, an existing matter can be selected for further examination or a new matter can be created.
Notify & Track
The different groups of potential custodians for a matter may have different hold requirements or require different instructions – with DiscoverIQ you can track any number of notifications from a Hold Notification dashboard within each matter. At the highest level you can see how many notices have been sent and how many custodians have acknowledged receipt. Setting up a new notice is as easy as choosing from your custom library of templates that include a pick-list of variables for easy re-use. Each notice can include an initial notice, scheduled follow-ups, escalations, reminders and attachments. Choosing individual custodians, escalations or groups is easy with a built-in Active Directory integration. Once you’re inside an active notification, you can easily track who has confirmed receipt and see a full audit trail of all communications.
True Early Case Assessment
DiscoveryIQ brings Early Case Assessment to where it belongs in the EDRM process, prior to collection. By providing analysis and document viewing capabilities during the Identification phase of the EDRM, DiscoveryIQ enables legal teams to determine who the real custodians in a case are, what the most salient matter terms are, and determine the quantity of data that will likely make it to downstream review processes. This intelligence ultimately lets legal teams make an informed settle vs. litigate decision as early as possible in the legal process.
Avoid Over Collection
DiscoveryIQ facilitates the investigation and analysis of legal matters by custodian groupings and subject matter. Users can leverage Microsoft Active Directory to provide a pick list of all possible custodians within an organization. Once chosen, custodial and subject matter based ESI is quickly incorporated into a virtual legal box, without moving any data across the enterprise.
Leveraging StoredIQ Analyze Anywhere, each legal box can be examined, analyzed, and culled based on any dimension or metadata attribute. This allows users to get early insight into a custodian’s data or a set of subject matter, giving them the ability to de-scope custodians and terms that obviously have no relevance to the case. Furthermore, users have an advanced search interface to find specific documents that contain data of interest, once identified, files can be marked with out-of-box tags (e.g. Escalate, Non-Responsive, Privileged, etc.) or with custom-created tags. All search keywords, phrases, and content entities are highlighted when viewing file content, enabling the investigator to better understand the context around particular subject matter.
Throughout the entire process, the StoredIQ Scoreboard displays a running count of the files eliminated from consideration, automatically calculating the potential savings during the downstream review cycle. Since this Scoreboard provides the estimated costs of formal Review, legal counsel can formulate legal strategies not only sooner, but more accurately determine a “litigate vs. settle” assessment.
Single-instance Collections & Export
Once the analysis is complete, the culled down data set can be collected and preserved to a secure retention server using single-instance incremental collection. This means that ongoing collections within a case will only need to collect new or edited documents and that documents that have already been collected for a previous case don’t need to be re-collected – greatly reducing collection time, storage requirements and allowing the legal team to leverage tags from previous cases, especially in companies with a multitude of serial litigants. Exports can be created in several different formats and likewise can be set to only export incremental data, avoiding costly duplicative review.
